Never before has there been more evidence of outright contempt for our Constitution than under the current liberal hegemony presiding over the executive and legislative branches of our federal government.
The protagonist of this Leftist regime is, of course, Barack Hussein Obama, who promised his constituents, "This is our moment, this is our time to turn the page on the policies of the past, to offer a new direction. We are fundamentally transforming the United States of America. And generations from now, we will be able to look back and tell our children that this was our time" [emphasis added].
Obama proclaimed, "Everywhere we look, there is work to be done. The state of the economy calls for action, bold and swift, and we will act -- to lay a new foundation for growth."
In his inaugural speech, Obama declared, "The question we ask today is not whether our government is too big or too small, but whether it works," signaling his rejection of the old paradigm, which pitted the conservative position, "government is the problem," against the liberal position, "government is the solution."
Thus, by virtue of his election to the presidency nearly one year ago, he believes he has the authority to establish a new paradigm to "fundamentally transform" our nation by creating "a new foundation."
However, if we are a nation of laws with a national government limited by our Constitution, and, indeed, we are, then Obama has no legal authority to "transform" our government.
Those who laid our constitutional foundation were very clear about its limits on government.
Our Constitution's principle author, James Madison, wrote, "The powers delegated by the proposed Constitution to the federal government are few and defined [and] will be exercised principally on external objects, as war, peace, negotiation and foreign commerce."
Concerning the legislature's authority, Thomas Jefferson asserted: "[G]iving [Congress] a distinct and independent power to do any act they please which may be good for the Union, would render all the preceding and subsequent enumerations of power completely useless. It would reduce the whole [Constitution] to a single phrase, that of instituting a Congress with power to do whatever would be for the good of the United States; and as sole judges of the good or evil, it would be also a power to do whatever evil they please. Certainly, no such universal power was meant to be given them. [The Constitution] was intended to lace them up straightly within the enumerated powers and those without which, as means, these powers could not be carried into effect."
Madison added, "If Congress can do whatever in their discretion can be done by money, and will promote the General Welfare, the Government is no longer a limited one, possessing enumerated powers, but an indefinite one, subject to particular exceptions."
But too many among us have become so fixated on the superficial parameters of today's political debates rather than demand an answer to that most essential question: What is the constitutional authority for Obama's proposals now being debated in Congress?
For example, amid all the acrimony over Obama's transformation of health care, the debate should not be centered on which plan is better, but whether constitutional authority exists for any of the plans under consideration.
Unfortunately, such inquiry is scarce, and hardly noted.
Last week, however, three leading Democrats in Congress were asked during news conferences to cite the constitutional authority for their healthcare proposals. To a one, they responded with answers that betrayed unmitigated arrogance and a disdain for our Constitution second to none in our nation's noble history.
"Are you serious? Are you serious?" replied House Speaker Nancy Pelosi when asked specifically about the constitutional authority for Obama's health care proposal. Pelosi's spokesman later clarified, "You can put this on the record: That is not a serious question. That is not a serious question." (Apparently, there was an echo in the chamber.)
Democrat House Majority Leader Steny Hoyer attempted to answer the question by demonstrating his illimitable ignorance on the subject: "Well, in promoting the general welfare the Constitution obviously gives broad authority to Congress to effect [a mandate that individuals must buy health insurance]. The end that we're trying to effect is to make health care affordable, so I think clearly this is within our constitutional responsibility."
Perhaps Hoyer should take a basic civics course on the "General Welfare" clause in Article 1, Section 8, as written by James Madison. On the limitations of the Constitution, Madison wrote: "I cannot undertake to lay my finger on that article of the Constitution which granted a right to Congress of expending, on objects of benevolence, the money of their constituents..."
Finally, Democrat Patrick Leahy, Chairman of the Senate Judiciary Committee (where Rule of Law once prevailed), responded to the question of constitutional authority by insisting, "We have plenty of authority. ... I mean, there's no question there's authority. Nobody questions that. Where do we have the authority to set speed limits on an interstate highway? The federal government does that on federal highways." (No, actually, the states set speed limits, and only misinterpretation of the Commerce Clause by judicial activists could be construed to give the federal government such authority.)
As for Obama, his publicist, Robert Gibbs, claimed, "I won't be confused as a constitutional scholar, but I don't believe there's a lot of -- I don't believe there's a lot of case law that would demonstrate the veracity of [questions about constitutional authority]."
For sure, nobody will confuse Gibbs with a scholar of any stripe. And, we would remind Gibbs that when the Clintonistas attempted to nationalize healthcare (18 percent of the U.S. economy) back in 1994, the bi-partisan Congressional Budget Office issued this piece of analysis: "The government has never required people to buy any good or service as a condition of lawful residence in the United States. An individual mandate ... would impose a duty on individuals as members of society [and] require people to purchase a specific service that would be heavily regulated by the federal government."
Remarkably, neither Obama's bĂȘte noire, Fox News, nor any nationally syndicated conservative column, devoted air time or print to these egregiously errant responses.
To be sure, there are a few Republicans who have questioned Obama's authority. Utah Republican Sen. Orrin Hatch proposed an amendment requiring swift judicial review of the health care folly if it is ultimately passed into law. Not surprisingly, Democrat Sen. Max Baucus, chairman of the Senate Finance Committee, refused to take up Hatch's amendment, insisting that it was a matter for the Judiciary Committee -- the very committee chaired by the aforementioned Senator Patrick "We have plenty of authority" Leahy.
In order to divine the real source the Left claims as its authority for "fundamentally transforming the United States of America," consider this congressional inquiry from last March.
Republican Rep. Michele Bachmann dared ask Obama's tax cheat Treasury Secretary, Timothy Geithner, "What provision in the Constitution could you point to gives authority for the actions that have been taken by the Treasury since March of '08?"
Geithner responded, "Oh, well, the -- the Congress legislated in the Emergency Economic Stabilization Act a range of very important new authorities."
Bachmann tried again: "Sir, in the Constitution. What in the Constitution could you point to gives authority to the Treasury for the extraordinary actions that have been taken?"
Geithner's response: "Every action that the Treasury and the Fed and the FDIC is -- is -- has been using authority granted by this body -- by this body, the Congress."
The "authority granted by this body, the Congress."
In every successive Congress since 1995, conservative Arizona Republican Rep. John Shadegg has sponsored the Enumerated Powers Act (HR 1359), which requires that "Each Act of Congress shall contain a concise and definite statement of the constitutional authority relied upon for the enactment of each portion of that Act."
The measure continues to fail, however, because of a dirty little secret: There is no legitimate constitutional authority for almost 70 percent of current federal government programs, and, thus, no authority for the collection of taxes to fund such activities.
Though Obama swore to "preserve, protect and defend the Constitution of the United States," and every member of Congress has pledged "to support and defend the Constitution of the United States against all enemies, foreign and domestic," and "bear true faith and allegiance to the same," Democrats, and too many Republicans, have forsaken their sacred oaths.
In doing so, they have inflicted grievous injury upon our Constitution, thereby placing our Essential Liberty in eminent peril.
In May 1775, at the onset of the hostilities that gave rise to our Declaration of Independence and Constitution, the Second Continental Congress adopted a resolution calling on the states to prepare for rebellion. In its preamble, John Adams advised his countrymen to sever all oaths of allegiance to the Crown.
Since that time, generations of American Patriots have honored their oaths, shed their blood, given their lives -- but not to the crown of any man or a partisan sect. Instead, these sacrifices have been made to support and defend our Constitution and the Rule of Law it established.
Put simply, there is no authority for a "constitutional rewrite" by Barack Hussein Obama, nor Nancy Pelosi, nor Steny Hoyer, nor any like-minded revisionists. Such contempt for our Constitution, such willful violation of their sacred oaths is a disgrace to the selfless dignity of generations of Patriots before them.
At present, we have a gang of outlaws at the helms of the executive and legislative branches. Under such despots, we are being unlawfully taxed without lawful representation. Sound familiar?

Today a hero died
He was getting old and paunchy And his hair was falling fast, And he sat around the Legion, Telling stories of the past.
Of a war that he once fought in And the deeds that he had done, In his exploits with his buddies; They were heroes, every one.
And 'tho sometimes to his neighbors His tales became a joke, All his buddies listened quietly For they knew where of he spoke. But we'll hear his tales no longer, For ol' Bob has passed away, And the world's a little poorer For a Soldier died today.
He won't be mourned by many, Just his children and his wife. For he lived an ordinary, Very quiet sort of life. He held a job and raised a family, Going quietly on his way; And the world won't note his passing, 'Tho a Soldier died today.
When politicians leave this earth, Their bodies lie in state, While thousands note their passing, And proclaim that they were great. Papers tell of their life stories From the time that they were young But the passing of a Soldier Goes unnoticed, and unsung.
Is the greatest contribution To the welfare of our land, Some jerk who breaks his promise And cons his fellow man?
Or the ordinary fellow Who in times of war and strife, Goes off to serve his country And offers up his life?
The politician's stipend And the style in which he lives, Are often disproportionate, To the service that he gives.
While the ordinary Soldier, Who offered up his all, Is paid off with a medal And perhaps a pension, small. It's so easy to forget them, For it is so many times That our Bobs and Jims and Johnnys, Went to battle, but we know,
It is not the politicians With their compromise and ploys, Who won for us the freedom That our country now enjoys. Should you find yourself in danger, With your enemies at hand, Would you really want some cop-out, With his ever waffling stand?
Or would you want a Soldier-- His home, his country, his kin, Just a common Soldier, Who would fight until the end.
He was just a common Soldier, And his ranks are growing thin, But his presence should remind us We may need his like again. For when countries are in conflict, We find the Soldier's part Is to clean up all the troubles That the politicians start.
If we cannot do him honor While he's here to hear the praise, Then at least let's give him homage At the ending of his days.
Perhaps just a simply headline In the paper that might say:
"OUR COUNTRY IS IN MOURNING, A SOLDIER DIED TODAY." Pass On The Patriotism! YOU can make a difference

Obama's White House is Falling Down

In the sixth month of his presidency, Obama has turned an economic downturn into an economic disaster, taking over and trashing entire companies, and driving the nation deep into deficit spending expected to pass 10 trillion dollars.
Abroad, Obama seems to have no other mode except to continue on with his endless campaign, confusing speechmaking with diplomacy. It is natural enough that Obama, who built his entire campaign on high profile public speeches reported on by an adoring press, understands how to do nothing else but that.
Ego driven photo op appearances and clueless treatment of foreign dignitaries
While the press is still chewing over Obama's Cairo speech, this celebrity style coverage ignores the fact that Obama's endless world tour is not actually accomplishing anything. Instead his combination of ego driven photo op appearances and clueless treatment of foreign dignitaries have alienated many of America 's traditional allies. Those who aren't being quietly angry at Obama, like Brown, Merkel or Netanyahu, instead think of him as as absurdly lightweight, as Sarkozy, King Abdullah or Putin do.
While his officials carry out their dirty economic deeds, Obama responds to any and every crisis as if it were a Mickey Rooney and Judy Garland musical, with a cry of, "Let's put on a show." Thus far Obama has put on "shows" across America , Europe and the Middle East . And what the adoring media coverage neglects to cover, is that Obama's shows have solved absolutely nothing. They have served only as high profile entertainment.
Neither alienating America 's traditional allies, through a combination of arrogant bullying and ignorance, nor appeasing America 's enemies, has yielded any actual results. Nor does it seem likely to. Islamic terrorism is not going anywhere, neither are the nuclear threats from North Korea and Iran . While Obama keeps smiling, the global situation keeps growing more grim.
At home, if Obama was elected as depression era entertainment, the charm of his smiles and his constant appearances on magazine covers appear to be wearing thin on the American public. Despite the shrill attacks on Rush Limbaugh or the Republican Enemy of the Weak-- the Democratic party of 2009, is polling a lot like the Republican party of 2008. The Democrats have suddenly become the incumbents, and the only accomplishment they can point to is lavish deficit spending, often on behalf of the very same corporations and causes they once postured against.
The European Union Parliament's swing to the right cannot be credited to Obama, though doubtlessly some European voters seeing socialist economic crisis management on display in the world's richest country decided they wanted none of it, but it is part of a general turning against federalism. And Obama's entire program is dependent on heavily entrenching federalism at the expense of individual and state's rights. Yet that is precisely his achilles heel with independent voters who are polling against more taxes and expanded government. And no amount of speeches by Obama can wish away his 18 czars or the national debt he has foisted on generation after generation of the American people.
That leaves Obama with a choice between socialism and the independent voter. And thus far he has chosen socialism.
Obama's tactic of hijacking Bush Administration era policies on the economy and the War on Terror, and exploiting them as trojan horses to promote his own agenda, have left him coping with a backlash from his own party, as well as general Republican opposition.
His Czars are meant to function as the bones in an executive infrastructure accountable to no one, but a lack of accountability isn't just another word for tyranny, but for incompetence. A functional chain of command is accountable at multiple levels if it is to function effectively. Obama's White House by contrast is in a state of over-organized chaos, the sort of organized disorganization that undisciplined egotistical leftists naturally create for themselves, complete with multiple overlapping levels of authority and no one in charge but the man at the top, who's too busy doing other things to actually be in charge.
Dennis Blair as National Intelligence, who collaborated with the Muslim genocide of Christians in East Timor , trying to muscle out the CIA to create his own intelligence network, is typical of the kind of chaos being spawned by every chief in an expanding government bureaucracy working to make sure that all the Indians answer to him. Similarly the National Security Council wrestling with the State Department, highlighted by Samantha Power getting her own specially created NSC position to butt heads with Secretary of State Hillary Clinton, illustrates the state of conflict and chaos in American foreign affairs. A state of chaos so pervasive that incompetence has now become commonplace, and no one can even be found to double check the spelling of a Russian word that is meant to be the theme of American's diplomatic reconstruction with Russia , or to pick out a gift for the visiting British Prime Minister.

Meanwhile on the economy, Obama exploited the ongoing bailouts, transforming them from bailouts into takeovers meant to shift the balance of power in what had been a democracy and socially engineer not only corporations, but the lives of ordinary Americans. But the public's patience with corporate bailouts is at an end, most Americans were never happy with them to begin with, and want them to end. The death of Chrysler at the hands of Fiat and the UAW might look like a victory in the union ranks, but it doesn't play too well outside Detroit . And tacking on CAFE standards that will kill the pickup truck and the SUV will badly erode Obama in the swing states, if exploited properly in 2010 and 2012. Despite the constant media barrage, orchestrated out of the White House, the public is growing disenchanted with the performance of Obama and the Democrats.
With unemployment booming and the economy dropping, the jobs aren't there and the spending is out of control. Republicans today are polling better on ethics and the economy, than the Democrats are. That shows a trend which is likely to register in the mid-term elections in 2010, in the same way that the EU parliamentary elections served as a shock to the system.
In the opposition, Republicans are free to embrace the rhetoric of change, to champion reform and push libertarian ideas about the size and scope of government. In turn all Obama has is his celebrity fueled media spectacle world tour. A charade now serving as a parallel to the depression era entertainment that functioned as escapism in a dour time. But before long, it may be Obama that the American public will want to escape from.

Obama has tried to play Lincoln, Reagan, JFK and FDR-- but in the end he can only play himself, a shallow, manipulative and egotistical amateur who is in over his head, and trying to drag the country down with him. Obama's White House is falling down and while the flashbulbs are still glittering and the parties are going on in D.C. and around the world, Obama and the Democratic Congress may be headed for a recession of their own.

Just in case anyone needs a reminder........
Obama recently approved a 2% salary increase for all federal employees effective January 1, 2010.
Members of the executive, legislative and judicial branch are due for an automatic pay increase in January as well.
All this on the backs of seniors who will not incur any COLA increases for several years.
For the first time in history, the Congress will not allow an increase in the social security COLA (cost of living adjustment).
In fact, The Henry J. Kaiser Family Foundation predicts there may not be any COLA for the next three years.
However, the personnel monthly Medicare insurance premium will be increased from the 2009 premium of $96.40 to $104.20 in 2010 and to $ 120.20 for the year 2011.
Send this to all seniors that you know.
Remind them to not vote for the incumbent senators and congressmenin the 2010 and the 2012 elections.

The audacity of hope?
I am in awe of the audacity of the administration in the pursuit of their agenda. Polls for healthcare this morning show a national disapproval rate of 57 percent, higher in some other polls. The American people, finally, are awakening to the fact that this administration, in collusion with Pelosi and the pathetic Reed, are attempting to overthrow the free market system and free enterprise. At every turn the Dems hierarchy blusters "I am not tired", "there is much to do and we will do it." There is more hot air and less substance concerning content each day. A friend said the airwaves (my ranting) have been kind of slow lately and I have to agree with him.
Confusion is running amuck here. Obama is pushing health care like a bull in a china shop. To add to the daily fare he has his Department of Education look at changing the school year, month, week or day to get students a longer time to learn. This is becoming to familiar. Health care stalls or reverses and lets add something new to the plate, make lots of noise about how critical it is to solve this problem or our country will fail. Now the inept, liberal media and the dysfunctional Charles Gibson will latch onto this and attempt to make a big deal out of longer days or years for students. This will make us more competitive on the world stage.
Excuse me and make no excuse for my country Mr. Obama. We put men on the moon, co-built a space station, have a military that is unparalleled because of advancements in technology, well ahead in medical advancements, the economy, industry and financial services. More advanced in all areas and not because of anything you Mr. President have done. Yes, we have problems but if you examine them factually most all can be traced to the Dems from the Carter administration on. Who gave you the right, legally or morally, to force GM and Chrysler into bankruptcy. Who gave you the right to rearrange the financial industry or pump as much of our money into their salvation. Let them fail. What has failed here is the Presidency and the incredible push for power from the Dems pitiful elite. Lots of stuff started, nothing complete. Where is "cap and trade", closing Gitmo, ending the Iraq war and how long are you going to "screw" our troops in Afghanistan? When are you going to realise that you DO NOT KNOW the answers and have surrounded yourself with equally inept advisors whose backgrounds are as empty as your. There is dishonesty at every turn, ignorance abounds and you and your administration have hurt this country and its fine citizens with your arrogance and multiplicity.
1.45 trillion in debt and massive, indefensible egos to show for it. Time has a way of healing all wounds and wounding all heals. 2010 elections are coming and I hope fervently that the American people will not forget.
